Immediately after his observation, the witness sees that defendant Girkin states on a local news channel that a Su-25 had been hit between Snizhne and Grabovo.



On 17 July 2014 the television channel LifeNews reports that rebels claim that downed a transport aircraft of the type Antonov-26 of the Ukrainian airforce near Snizhne

The DPR then claims that an aircraft has been shot down. At 16:37 the following message is posted on the VK account strelkov_info: ‘A message from the people’s army. An AN-26 was just downed in the vicinity of Snizhne. I



Girkin stated in his witness examination by the Russian authorities in 2015 that on 17 July 2014 ‘at around 16:30 Moscow time’ (the same time zone as Donetsk) DPR commander Kep reported to him that at the end of the afternoon the air defence north of Snizhne had hit one of two Su-25 combat aircraft of the Ukrainian air force.



Not long after this, the defendants start to realise that they have not shot down a Sushka but rather a passenger aircraft. At first they appear to believe that two aircraft have been downed: a Boeing and a Sushka.

Dubinskiy calls someone named Igor, who tells him journalists are pestering him. They are saying a Boeing has crashed 80 kilometres from Donetsk. Igor asks Dubinskiy if this is true.



At this point, the account of the situation changes: the passenger aircraft was shot down by a Ukrainian Sushka and the DPR fighters then shot down that Sushka with the Buk.


This new version of events also features in a conversation between Kharchenko and Pulatov.

Pulatov then says that, shortly before, the ‘Sushka’ shot down a Chinese passenger aircraft. He is briefly interrupted by Kharchenko who says that they were dealing with the ‘Sushka’. Pualtov goes on by saying that they got the ‘Sushka’ immediately afterwards.



Dubinskiy appears to want to verify that MH17 may have been downed by their Buk, and he calls Pulatov. Dubinskiy asks Pulatov: ‘Did our Buk fire or not?’ Pulatov says that the Buk shot down a Sushka after the Sushka had shot down the Boeing. This was observed from the ground. Pulatov says he was in Marinovka himself, but ‘their men’ had seen this from Snizhne.



Two minutes later, Dubinskiy calls Girkin. Dubinskiy is pleased and asks if Girkin wants to hear some good news. He tells Girkin what he has heard from Pulatov: the Sushka shot down the Boeing and then our people hit the Sushka with the Buk. Girkin does not believe the story and thinks that in any case they will get the blame.



Kharchenko asks whether he should release the crash site to the OSCE. He is referring to the Organization for Security and Co-operation in Europe, which would be put in charge of the recovery mission. Dubinskiy says he should. He then asks whether Kharchenko is sure that their people saw it being hit by a Sushka, or whether it was actually their people who did it. Kharchenko says that it was not. Dubinskiy continues to ask questions: ‘It was Sushka, wasn’t it?’. Yes, it was a Sushka, Kharchenko says. ‘And then the Sushka was hit with a Buk by our people. Is that right?’ asks Dubinskiy. ‘First there was a bang in the air and then our bang,’ Kharchenko confirms.
